Sotomayor wants more diversity on court

The Fox News headline reads: “Sotomayor wants more diversity on court, after Obama picks Garland, a white Ivy male.”

“Justice Sonia Sotomayor says the Supreme Court needs more diversity, amid the politically charged debate about filling a vacancy on the high court.

“I … think there is a disadvantage from having (five) Catholics, three Jews, everyone from an Ivy League school,” Sotomayor, the court’s first Latina justice, said Friday at Brooklyn Law School.”

I went to the Constitution, to Article III where the Supreme Court is established and could find no qualifications for placing someone on the Supreme Court. Not even in the Federalist Papers, especially #76 where Hamilton writes about the Court.  There is discussion on who should make the appointment and who should review it and why, but not qualifications of the nominee. The role of the Supreme Court is in Article III, Section 2 and says:

The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority;—to all Cases affecting Ambassadors, other public Ministers and Consuls;—to all Cases of admiralty and maritime Jurisdiction;—to Controversies to which the United States shall be a Party;—to Controversies between two or more States;— between a State and Citizens of another State,—between Citizens of different States,—between Citizens of the same State claiming Lands under Grants of different States, and between a State, or the Citizens thereof, and foreign States, Citizens or Subjects.

 While not stated, the only requirement of a potential Justice was that they know the Constitution so they could carryout Section 2. They were to have no political role in the nation, nor consider social justice, certainly not legislate. In this case it didn’t matter if they were “white”, “Jew”, “Catholic” “Protestant”, “Non-believer in God”, or what school they attended. They were not there to represent any political party and the only ideology they were to be concerned with was that of the Constitution. Some of this can be gathered in Federalist #78 and is the reason why the Senate MUST approve every nominee.
The Supreme Court is to serve the Constitution not the people, except in serving the Constitution they also serve the people. Sotomayor’s remarks show us how perverted the Supreme Court has become.
